SERVICE AGREEMENT

1. All information presented by Fitness for Golf is for education purposes only. The material is not intended to be a substitute for medical counseling. The site is intended to help you make informed decisions about your diet, health and various exercises for golf. Before adhering to any of the information or recommendations presented throughout the Fitness For Golf web site and/or newsletter, please consult with your own physician or healthcare practitioner. Fitness For Golf reserves the right to refuse or cancel membership to any party for any reason, including certain medical conditions.

2. GENERAL TERMS AND CONDITIONS: You agree to: (a) maintain all equipment necessary for your access to and use of Fitness For Golf; (b) maintain the security of your user identification, password and other confidential information relating to your Fitness For Golf account; (c) be responsible for all charges resulting from use of your Fitness For Golf account, including unauthorized use prior to your notifying Fitness For Golf of such use and taking steps to prevent its further occurrence by changing your password; and (d) updating your personal information, including e-mail address.

3. MEMBERSHIP TERM: The membership period is 12 months or 1 year from the initial date of subscription.  Unless specified otherwise on this web site, after the Initial membership term, each membership is renewed every year and members are financially responsible for all associated renewal fees until notice of cancellation is received by Fitness For Golf. Fitness for Golf reserves the right to change its fee structure at any time, including to increase or decrease fees or add any new fees or charges at any time. However, Fitness for Golf will not change the subscription fee applicable to any period for which you have already elected to subscribe.

4.CANCELLATION BY YOU. 
You may terminate your account, effective at the end of the period for which you have subscribed to the Site, by sending an e-mail to: susan@fitnessforgolf.com. You will receive a confirmation e-mail upon receipt.You are responsible for all membership and other fees and charges incurred by you or by any user of your account up to the time the account is deactivated.

5.CANCELLATION BY Fitness for Golf. 
You agree that Fitness for Golf, in its sole discretion, may terminate your password, your account and/or your use of the Site, and remove and discard any Material within the Site, at any time and for any reason. You agree that any termination of your access to the Site under any provision of the these terms of service may be effected without prior notice, and acknowledge and agree that Fitness for golf may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Site. Further, you agree that Fitness for Golf shall not be liable to you or any third-party for any termination of your access to the Site; provided that Fitness for Golf refunds to you a pro rata portion of the membership fees paid by you for periods after the effective date of the termination.

By email: send an email to susan@fitnessforgolf.com indicating within the body of the message your intent to cancel.  Be sure to include your first and last name and user name.  Please note that Fitness For Golf will not accept or open email communications with attachments.

6. CHANGES TO SERVICE. Fitness for Golf may change, modify, add, suspend or discontinue, temporarily or permanently, any aspect of the Site at any time, including the availability of any feature, database, or content, with or without notice to you. Fitness for Golf may also impose limits on certain features and services or restrict your access to part or all of the Site without notice to you. You agree that Fitness for Golf shall not be liable to you or to any third party for any such change, modification, addition, suspension, discontinuance, limitation or restriction.

7. WAIVER, RELEASE AND LIMITATION OF LIABILITY: You agree that neither Fitness For Golf, LLC, nor its affiliates, subsidiaries, officers, directors, employees, agents, consultants or information providers or suppliers, shall have any liability to you under any theory of liability or indemnity in connection with your use of Fitness For Golf, LLC You hereby release and forever waive any and all claims you may have against Fitness For Golf, LLC, its officers, directors, employees, agents, consultants, information providers or suppliers for losses or damages you sustain in connection with your use of Fitness For Golf, LLC.

8. Notwithstanding the foregoing paragraph, the total liability of Fitness For Golf, LLC and its officers, directors, employees, agents, consultants, information providers and suppliers, if any, for losses or damages shall not exceed the fees paid by you for the particular information or service provided. All other damages, direct or indirect, special, incidental, consequential or punitive arising from any use of the information or other parts of Fitness For Golf, LLC are hereby excluded even if Fitness For Golf, LLC or its officers, directors, employees, agents, consultants, information providers or suppliers have been advised of the possibility of such damages. Void where prohibited by law.

9. NOTICE: Fitness For Golf may deliver notice to you under this Agreement by means of electronic mail, a general notice on Fitness For Golf or by written communication delivered by first class U. S. mail to your address on record in the Site's account information. You may give notice to Fitness For Golf at any time via electronic mail to Fitness For Golf or by letter delivered by first class postage prepaid U. S. mail or overnight courier to the following address:
